Practical legal support for property transactions
We act for buyers and sellers of residential and commercial property in the Australian Capital Territory and Victoria. Our focus is on managing legal risk and ensuring transactions progress efficiently from contract review through to settlement.
Vendor Transactions
We assist vendors with the preparation and completion of property sales.
This includes drafting and reviewing contracts of sale, preparing and reviewing disclosure documentation (including Section 32 Vendor Statements in Victoria under the Sale of Land Act 1962 (Vic)), and ensuring all relevant information is properly disclosed, including title particulars, encumbrances, planning controls, permits, services and owners’ corporation details where applicable.
We also liaise with mortgagees regarding discharge of mortgage and manage settlement through PEXA.
Purchaser Transactions
We review contracts and disclosure documents prior to purchase to identify legal and practical risks and advise on key terms affecting the transaction.
This includes contract review, assessment of disclosure documentation (including Section 32 statements in Victoria), and advice on title issues, planning controls, encumbrances, special conditions, settlement terms and statutory obligations.
We also advise on cooling-off rights (where applicable), deposit arrangements, owners corporation or body corporate disclosures, stamp duty obligations under the Duties Act 2000 (Vic), and first home buyer concessions and exemptions.
We liaise with financiers and other stakeholders throughout the transaction and manage settlement through PEXA.
Commercial Property and Leasing
We act in commercial property transactions and leasing matters across the ACT and Victoria.
This includes the acquisition and disposal of commercial property, due diligence, and the drafting, review and negotiation of commercial and retail leases.
We focus on ensuring property arrangements are properly documented and aligned with the commercial and operational objectives of our clients.
